Booking Fee/Deposit A non-refundable booking fee of £400 is charged when the client signs this contract. This fee is deducted (in full) from the TOTAL price. Payments Following payment of the booking fee, the remaining balance is due to be paid no later than 30 days before the Wedding Date. Reorders All reorders shall be treated as an extension of this contract and no responsibility for errors will be accepted unless orders are given in writing. All re-orders must be paid for in full at the time of ordering. TERMS AND CONDITIONS It is agreed that the terms set out in this contract is the total agreement made between the parties and that no variation or modification of this document shall be effective unless agreed by both parties in writing. This contract is between Binky Nixon Photography and The Bride/Groom, who is the client, regardless of who is financially responsible for the agreement. 1. Special Requests/Coverage The client understands and accepts that the photographic coverage will be as the photographer's professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. 2. The Photographer In the unlikely event that the photographer is injured or becomes too ill to photograph the event, the photographer shall refund all payments to the client but shall have no further liability with respect to the agreement. Every effort will be made to find a replacement however no responsibility lies with the photographer in terns of the quality produced by the replacement. 3. Images All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. The photographer will produce images in a creative style the same as used on the website and in sample albums. Although the photographer and any assistants shall exercise all reasonable skill, care and diligence in the discharge of their duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record, the photographer will only be responsible for the return of all the money paid to date, although every effort will be made to retake the photographs. 4. Copyright All images and the copyright of them are owned by Binky Nixon Photography. Personal usage for the couple, friends and family is allowed however creditation to Binky Nixon Photography is required. Permission must be obtained from the photographer if you want to pass images to other suppliers, venues, or parties not involved in the wedding. 5. Negatives/Digital Files Negatives/digital files remain the property of the photographer. Where digital files have been purchased personal printing rights is included in the package. 6. Licence The photographer/s shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The photographer/s' judgement regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. 7. Force Majeure or Act of God The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. 8. Restrictions
 The Photographer will endeavour to shoot technically and artistically crafted photographs, but the Photographer cannot be held responsible for bad weather, poor lighting at venues or lack of co- operation from, or restrictions imposed by, all or any relevant authorities, e.g. Church or Registry officials or any other party present on the day. 10. Limitation of Liability In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 11. Refreshments For any event coverage longer than 4 hours, the Client will procure the facilitation of refreshments for the Photographer and assistant if present. 12. Albums/Orders In order to honour the album price at the time of booking, album orders must be placed within 12months of the wedding. Orders can be placed after this date but costs will increase. Any prints or digital files required after 12months of the wedding will have a admin fee applied. 13. Storage All digital files are backed up straight after the date shot, hard drives are stored away after 12months. It is advised that all clients back up their own memory stick of images as the photographer cannot be held responsible for loss of images. The photographer will make every effort to store images however is only responsible for files for up to 12months after the shoot date. 14. Re-Touching Where possible a basic amount of re-touching will be carried out on images to ensure the final set of pictures look finished. This may include, fire exits, signage, light switches etc. Should anything additional be required a relevant fee can be discussed with the photographer. 15. Cancellation The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. Should cancellation be received by the photographer less than 8 weeks prior to the date of the ceremony, the client shall in addition pay the remaining balance for the agreed package. The said sum shall be payable as compensation due to Binky Nixon Photography being unlikely to re book the date. 16. Date Move If for any reason your wedding date gets pushed back to the following calendar year a 10% fee of the total price will be applied. 17. Usage 
The photographer will ensure prior agreement from the couple before using any images on both website and social media.
